If you’ve been quietly wondering whether divorce might be the right path but feel overwhelmed by the idea of court battles, long timelines, or high-conflict legal drama, you’re not alone.
Many of the women I work with have already made the emotional decision to end their marriage. But what often holds them back is the uncertainty around what comes next. They want a process that feels clear, affordable, and respectful. They want to move on with their lives without spending months fighting in court or draining their savings on legal fees.
That’s why one of the most common questions I hear during the “month of divorce” in January is: “Can I really be divorced before the end of the year?”
In California, the answer can be yes. But there is one key requirement that catches many people off guard.
The 6-Month Waiting Period: What It Means and What It Doesn’t
California law requires a mandatory six-month waiting period in every divorce case. This timeline cannot be shortened or waived, even if both people agree on everything. No matter how peaceful the split is, a judge cannot finalize the divorce until six months have passed.
The most important thing to understand is when that six-month clock starts. It does not begin when you decide to get divorced. It does not start when you file papers or talk to a lawyer. The clock only starts once your spouse is officially served with divorce documents.
So if your goal is to be legally divorced by December 31, 2025, you must file and serve your spouse by June 30, 2025.
What If You’re Both On the Same Page?
If you and your spouse are in agreement about getting divorced and want to avoid a legal battle, you may be a good fit for an uncontested divorce. This option is designed for couples who want to move forward with mutual respect, save money, and avoid court.
Uncontested divorces are faster, more affordable, and much less stressful than contested cases. You can typically complete everything within a few months, depending on how quickly you both respond and how organized you are.
And if you begin the process now, you can still meet the timeline to finalize your divorce before the end of the year.
